Acceptance of Terms

By scheduling an appointment, receiving services, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

Services Provided

Smog Mart Inc. provides:

• Smog check and emissions testing services
• Automotive repair and maintenance services
• Diagnostic services
• Fleet maintenance services
• Parts sales and installation
• Vehicle inspections

All services are performed by ASE-certified technicians in accordance with industry standards and applicable regulations.

Appointments and Scheduling

Appointment Booking

• Appointments can be scheduled online, by phone, or in person
• We reserve the right to confirm appointment availability
• Walk-in customers are welcome but appointments receive priority
• Service times are estimates and may vary based on vehicle condition

Cancellation Policy

• Please provide at least 2 hours notice for appointment cancellations
• Late cancellations or no-shows may result in a service fee
• We reserve the right to refuse future appointments for repeated no-shows

Pricing and Payment

Service Pricing

• All prices are subject to change without notice
• Estimates are provided in good faith but final costs may vary
• Additional work requires customer authorization before proceeding
• Diagnostic fees may apply and will be disclosed upfront

Payment Terms

• Payment is due upon completion of services
• We accept cash, credit cards, and approved financing
• Financing is subject to third-party approval (Snap Finance)
• Returned checks will incur additional fees

Estimates and Authorization

• Written estimates are valid for 30 days unless otherwise specified
• Customer authorization is required for work exceeding estimates
• We will contact you before performing additional work
• Emergency repairs may be performed to ensure vehicle safety

Warranties and Guarantees

Service Warranty

• New parts are warranted for 12 months or 12,000 miles, whichever comes first
• Labor is warranted for the specific work performed
• Warranty covers defects in materials and workmanship
• Original receipt required for warranty claims

Warranty Limitations

• Warranties are non-transferable
• Normal wear and tear is not covered
• Damage from abuse, neglect, or accidents is not covered
• Warranties may be voided by unauthorized repairs
• Used parts carry limited or no warranty

Customer Responsibilities

As a customer, you agree to:

• Provide accurate information about your vehicle and its condition
• Remove all personal items from your vehicle before service
• Inform us of any known vehicle problems or concerns
• Follow recommended maintenance schedules
• Pay for services in accordance with these Terms
• Pick up your vehicle within 3 days of completion
• Treat our staff and facilities with respect

Vehicle Storage and Abandonment

• Vehicles left over 3 days after completion may incur storage fees
• Storage fees are $100 per day after the 3-day grace period
• Vehicles left over 30 days may be considered abandoned
• Abandoned vehicles may be disposed of according to California law/lien sale
• Customer is responsible for all towing and storage costs
• We are not responsible for items left in vehicles

Limitation of Liability

To the maximum extent permitted by law:

• Our liability is limited to the cost of the services performed
• We are not liable for consequential or incidental damages
• We are not responsible for pre-existing vehicle conditions
• We are not liable for loss of use, towing, or rental car costs
• Our liability does not extend beyond our direct control
• Some states do not allow limitation of liability, so this may not apply to you

Smog Check Services

Testing Requirements

• Vehicle must be in proper operating condition for testing (i.e., no coolant/large leaks)
• Engine must be at normal operating temperature
• Fuel tank must be between 1/4 and 3/4 full
• All emissions equipment must be present and functional

Test Results

• Test results are reported directly to the DMV
• Failing vehicles may require repairs before re-testing
• Re-test fees may apply for failed inspections
• We guarantee accurate testing procedures

Website Use

Acceptable Use

• Use the website only for lawful purposes
• Do not attempt to gain unauthorized access
• Do not interfere with website functionality
• Do not use automated systems to access the site

Intellectual Property

• All website content is owned by Smog Mart Inc.
• Unauthorized use of content is prohibited
• Trademarks and logos are protected intellectual property

Dispute Resolution

We are committed to resolving disputes fairly and quickly:

• Please contact us directly to resolve any concerns
• We will work in good faith to address legitimate complaints
• Disputes may be subject to binding arbitration
• California law governs these Terms
• Sacramento County courts have jurisdiction over disputes

Indemnification

You agree to indemnify and hold harmless Smog Mart Inc., its employees, and agents from any claims, damages, or expenses arising from your use of our services or violation of these Terms, except where prohibited by law.

Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
